Terms and conditions of purchase

Thank you for your interest in purchasing one of my artworks or services.

Below are the terms and conditions that apply to your purchase, they are here to explain your rights and if you have any questions you are always welcome to contact us and we will be happy to explain how this works.

1.General Terms and Conditions

These general terms and conditions apply when you place an order  with Jacqueline Rolls Artist for artworks

By accepting these General Conditions, you confirm that you are at least 18 years old  and that you will comply with the General Conditions as detailed below

2. Orders

When you purchase an item a purchase agreement is entered into. We encourage you to save the order confirmation for any future contact.

Please note that all original handmade original works are unique and one of a kind and not mass-produced. unless otherwise stated e,g prints.

2.a  Ordering Items that have already been created and are available to purchase. If you change your mind please check whether the items have already been dispatched or a courier has been arranged, f that has happened please refer to, section, 7 refunds.

3. Commissions 

Creating a bespoke piece of work is always an interesting experience and may take some time to design the piece,  once the proposal has been agreed a contract will be drawn up in advance of creating the artwork.

A non-refundable deposit of  50% of the cost will need to be paid before the work is started.  You will be sent photographs and a mini film which will be sent to you once the item is completed. The remainder of the fee will need to be paid before the item is posted. Please note that should the work not be completed to a situation that is out of our control e.g: long term illness, injury the full deposit will be reimbursed and the agreement canceled.

Please note that the creation of bespoke made to measure,  perishable items are  not covered by the standard cancellation rights   ( Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013  

The work will remain the property of the creator until it is posted, if you decide to cancel the order before it is posted  you will not receive a refund for any monies already paid.

4.Prices, fees, etc.

The prices apply to orders placed on this website /shop. All prices are in the currency stated on the Website and include VAT where specified.

Prices include VAT and all prices are correct at time of going to press. We reserve the right to alter prices either up or down, including any variations to the rate of VAT.

Please note also that local charges (fees, credit or bank card fees, sales tax, etc.) may apply such charges are at your expense and will not be refunded. Please note that you are responsible for the methods that you use to purchase the item and ensure that the funds are delivered safely.

5. Special offers

From time to time we may, for specific products, offer more favorable conditions than those provided for in these General Conditions, for example with regards to the extended right of withdrawal or free returns. Such more favourable conditions are valid only for a limited duration of time until the specific products are sold out and maybe cancelled by me at any time, on such occasions General Conditions will apply without amendments.

We reserve the right to alter prices either up or down, including any variations to the rate of VAT.

6. Shipping and delivery – ( art and craft items already made )

Products in stock will be delivered at the earliest convenience. Unless otherwise stated the delivery cost will be added to the cost of the item. All items will be sent by recorded delivery.

The expected delivery time for an order is set out in the order confirmation. In case of delay in delivery, we will inform you and continue to monitor the order. You may cancel the order if a delivery is delayed for more than 30 days and the delay is not due to you. (see 8a)

If you live within 25 miles of Southampton I am happy to arrange personal delivery or collection of my large sculptures.  For anywhere outside of this area, a courier fee will be charged the cost will depend on the item and distance.  Please contact me to discuss the delivery of large items such as the fantasy bird or penguins as this will need special delivery arrangements. ( see collection)

Postal delivery smaller items  –  depending on the delivery method you may be required to pick up the order at a specific delivery point. You or your representative are required to do so within the time specified in the notification of delivery. If you do not pick up the delivery in time you may be charged a fee and the order may be sent back to us at your expense. If we need to resend you will be charged for the delivery.

It is the buyer’s responsibility to inspect goods verifying quantity specifications and details. Upon receipt of the goods, the purchaser must raise any queries or complaints about the goods within 7 days ( otherwise; we will deem the purchase and delivery accepted by you.

Collection may be arranged and personal delivery may be possible if you live within 25 miles radius of Southampton Airport. Fuel mileage may be charged (45p per mile)

Please note: If items are collected or delivered the purchaser will be requested to inspect the item to check that they are in the condition that was agreed, should they then wish to return  and will then be sold as seen and thus not eligible for a refund, them to check that the item

Any returned goods which are not defective or faulty must be returned at your own cost. For more information, please refer to our T&Cs.

7. Refunds

 a. Refunds on items cancelled before posting  

Please note that this section applies to items that have already been made and are not commissioned as large bespoke artworks.

When an order is withdrawn by you, we will refund the price that you have paid for the products excluding any costs associated with placing the order, e.g if a courier has already been arranged then the cost will be deducted from the refund.

b .Refunds on items that have already been sent 

c. Once you receive the item you have up to 7 days to send a returns notification containing your name, address, e-mail address, the order number, and a specification of which products that the wish to return, otherwise; we will deem the purchase and delivery accepted by you.

You must ensure that the item has not been handled more than is necessary to determine its function or characteristics

Once the acceptance for the item to be returned has been made you must the item must be returned, immediately and within 14 days from the date of the withdrawal notification approval at your own expense.

d. You are responsible for the condition of the items during return shipment we therefore strongly recommend that you send these well packaged, in the same condition that it arrived and in their original box and/or packaging.

We also recommend that you use a  tracking service with compensation cover for the value of the item that you are posting so that if the item is damaged in return transport you have evidence and can claim against the delivery company.

e. Once the item is returned and providing the item(s) are still in a completely saleable condition and in their original packaging, we may deduct any depreciation in the value of the products or out of pocket expenses relating to the sale of the item i.e fees associated with card payments

We will reimburse you with the amount to be refunded as soon as possible and within 14 days of the withdrawal notification, once the items/s have been received.  The refund will be paid with the same payment method that you used to pay the withdrawn products unless otherwise agreed.

7.1  If the item appears to be damaged in transit 

In the unlikely event that your artwork appears to have been damaged through transit,  Please take detailed photographs of the outside of the packaging before you open it.

In the unlikely situation that the work has been damaged please take further photographs to record the extent of the damage.

It is essential that you notify us within 48 hours please also send the evidence that you have collected.

Next steps. Please save the original packaging and everything in the package until the claim is settled.

  • Do not throw out damaged items, even after you photograph them.
  • Do not reship items that were not damaged. Save them with the damaged items so that you have evidence to prove that the items were damaged in shipping .
  • You may be asked to take the entire package to your local Post Office or courier company facility for inspection.
  • We will also advise you as to what to do next and to arrange a refund or discuss of it is possible to send a replacement or alternative artwork or to explore alternative options.

8. Customer information  

You are responsible for the personal data that you provide to ensure that it is correct and complete. Please note that your data will be kept in accordance with the GPDR data protection regulations and will only be used for the purpose of contacting you about your purchase/activity. If you wish your details to be added to a mailing list you will need to provide permission for your details to be used for that purpose. please also refer to the privacy policy

9. Limitation of Liability 

Where applicable mandatory law does not provide otherwise, our liability is limited to direct damages, and under no circumstances are we liable for indirect damages such as loss of earnings, etc.

The Seller shall be under no liability for any failure to perform all or any part of its obligations under the Contract if such failure shall be due to the act of God, terrorism, strikes, lockouts, labour disturbances, or any circumstances that are out of their control.

Statute or any regulation of any government, public or local authority, delays or defaults of suppliers and subcontractors or without prejudice to the generality of the foregoing any other causes beyond the reasonable control of the Seller and this condition shall apply notwithstanding that it may conflict with any special condition.

10.Intellectual Property Rights 

The Website and all its content is owned by us or our licensors and protected by intellectual property and marketing legislation. This means that trademarks, company names, product names, images and graphics, design, layout, and information on products, services, and other content may not be copied or used without our prior written consent.

11.  Changes to the General Conditions

These General Conditions at any time. We will then set forth the changed General Conditions on the Website and they will enter into force once you have accepted them (in connection with a new order through the Website or while browsing the Website).

12. Waiver 

We reserve ourselves for any image or typographical errors on the Website, such as errors in product descriptions, technical specifications, inaccurate prices, or incorrect information with regards to whether a product is in stock. We are entitled to rectify any obvious errors and, at any time, to change or update the information on the Website accordingly.

The images on the Website are for illustration purposes only and do not guarantee to reproduce the exact number of products that you would receive at an order, nor the exact appearance, function or origin of the products.

13. Governing law and disputes

In the event of a dispute, we will strive to comply with any decision by the relevant consumer protection authorities.

Any dispute regarding the interpretation or application of these General Conditions shall be governed by and construed in accordance with the laws of the country and shall be subject to the non-exclusive jurisdiction of the court at the place of our incorporation. “Non-exclusive jurisdiction” means that you may bring a claim against us in another jurisdiction if provided by applicable mandatory law.
